Ordering

Once you have completed your order, an order confirmation will be sent to your email address. In the confirmation, you will find all information about products, price, billing, and shipping address. If there are any errors in the order confirmation, please contact us immediately via email at customer@shapd.se.

Delivery

Our normal delivery times are 2-5 or 14-28 days, depending on whether it is an in-stock item or a special order item. NOTE! Orders placed on the weekend will be shipped no earlier than the Monday after. If there are delays in delivery (without us having informed you of a longer delivery time), please contact us at the email address: customer@shapd.se.

Prices

All prices in the store are in SEK, and all prices are exclusive of VAT, unless otherwise stated. We reserve the right to price changes caused by changes in the supplier's prices, printing errors in the price list, as well as price errors due to incorrect information, and reserve the right to make adjustments.

Right of withdrawal

When purchasing goods on the website, you as a customer have a statutory right of withdrawal of 14 days from the date you received an ordered item. NOTE! This does not apply to the purchase of the treatment plan or the entire treatment, as the treatment plan and braces are custom made for the patient, see more below.

When exercising your right of withdrawal:

You must notify that you are withdrawing. The notification must be sent to us at customer@shapd.se. In your notification, your name, address, email address, order number, and the items to be returned must be clearly and distinctly stated. You must return the items to us immediately and no later than 14 days from the withdrawal notification. You are responsible for the return, delivery, and condition of the items upon return, and therefore the items must be sent securely and in the original packaging. We reserve the right to deduct an amount corresponding to the depreciation in value from the refund amount in case of use or damage to the item.

The right of withdrawal does not apply to:

Items that are sealed (sealed) for health or hygiene reasons and where the seal (seal) has been broken by you items that have the character of sealed sound or image recording, and where the seal has been broken by you. Complaints and claims

We inspect all products before they are shipped to you. If the product should nevertheless be damaged or incorrectly sent upon arrival, we commit ourselves according to applicable consumer protection legislation to remedy the defect at no cost to you. You must always contact us for approval before returning a defective item. The complaint must be sent immediately after the error is discovered.

How to complain:

Any errors and defects must always be reported to customer@shapd.se, where you provide your name, address, email address, order number, and a description of the error. If it is not possible for us to remedy the error or deliver a corresponding item, we will refund you for the defective item in accordance with applicable consumer protection legislation. We cover the return costs for approved complaints. We reserve the right to reject a complaint if it turns out that the item is not defective according to applicable consumer protection legislation. Limitation of liability

We assume no liability for indirect damages that may arise as a result of the product. We assume no liability for delays/errors due to circumstances beyond the company's control (Force Majeure). These circumstances may include labor disputes, fire, war, government decisions, reduced or missing delivery from supplier. In addition, we assume no liability for any changes to products/product specifications that have been changed by the respective supplier, and other factors beyond our control.

Product information

We reserve the right to any printing errors on this website as well as sold-out products. We do not guarantee that the images reflect the exact appearance of the products, as there may be visual color differences depending on screen, photo, and resolution quality. We always strive to present the products as accurately as possible.

Availability of Dentists:

Shapd is not accountable for the accessibility of partner dentists. Shapd will display the locations of partner dentists closest to the customer's provided postcode. This information will be accessible through a dropdown menu on the website, listing all partner dentist locations or via phone. Detailed information about the partner dentist will not be provided to the customer. Shapd will initiate contact with the customer to schedule the initial consultation for commencing the Shapd treatment. Subsequent appointments, as deemed necessary by the dentist, will be coordinated by the dentist. The partner dentist will reach out to the customer within 7 of the initial appointment for the fitting of Shapd aligners. Any attempt to contact the partner dentist for appointments outside of these terms will be considered a breach of the agreement.

Further Treatment:

Before completing the purchase, the customer acknowledges that Shapd is not responsible for any pre-whitening dental treatment. The sale of Shapd products is based on the assumption that the customer has a 'healthy mouth.' If the partner dentist determines that additional treatment is needed before whitening, the cost will be borne by the customer and agreed upon between the customer and the partner dentist. Once the necessary dental work is completed by the partner dentist to ensure a 'healthy mouth,' measurements for Shapd products can be released to the manufacturer for custom order.

Crowns, Veneers, Fillings, and Other Dental Restorations:

Due to the nature of the whitening procedure offered by Shapd, dental restorations such as crowns, veneers, fillings, etc., will not whiten in the process. Shapd disclaims responsibility for any color differences customers may experience if they choose not to replace these at an additional cost before whitening.

Appointment Cancellation:

Customers wishing to reschedule an appointment with a partner dentist can do so within 48 hours. They must arrange a subsequent appointment by contacting Shapd via telephone using the provided number at the time of initial contact. Additionally, they must send a written request via email to the email address patient@shapd.se.

Information about cookies

According to the law on electronic information, visitors to a website must be informed about the use of cookies for privacy reasons. The information in the cookie can be used to track a user's browsing. A cookie is a small text file that the visited website requests to store on your computer to provide access to various features. Personal information

By shopping at Shapd, you accept our data protection policy and our processing of your personal information. We protect your personal integrity and do not collect more information than necessary to process your order. We never sell or disclose your information to third parties without legal basis. Shapd Care AB is responsible for the processing of personal data that you have provided to us as a customer. Your personal information is processed by us to handle your order and in cases where you have requested newsletters or promotional offers - to customize marketing to your individual needs. The information below is a summary of how we, in accordance with the General Data Protection Regulation (GDPR), store and process your information.

What is personal information?

Personal information is any information that can be directly or indirectly attributed to a physical person.

What information do we store?

To handle your order and answer questions related to your order (customer service), we store your first name and last name, address, telephone number, email address, IP address, and purchase history. Your information is stored as long as we have a legal basis for processing your information, e.g., to fulfill the agreement between us or to fulfill a legal obligation under, for example, the Accounting Act.

Legal basis

In connection with a purchase, your personal information is processed to fulfill the agreement with you. Marketing, campaigns, and similar broadcasts occur with your consent. What information is shared, and for what purpose?

Payment provider

When completing a purchase, information is shared with our payment provider. The information stored includes first name, last name, address, email address, and telephone number. If you choose to pay by invoice, your social security number is also stored with the payment provider. The information is stored to complete the purchase and to protect the parties against fraud. The payment providers (payment methods) we use include: Klarna, Swish, Resurs Bank, Nets.

Freight company

To deliver your orders and fulfill our agreement, we must share specific information with the freight company. The information shared with the freight company includes first name, last name, and delivery address. Email address and/or mobile number may also be shared with the freight company for notification. The freight companies we work with include: Postnord.

Newsletter

If you have chosen to subscribe to our newsletter, first name, last name, and email address are shared with our newsletter provider. This is done to keep you updated with information and offers for marketing purposes. We use Hubspot for sending newsletters.

Right of access

You have the right to receive a copy of all information about you stored with us. The copy is provided electronically in a readable format.

Right to rectification

You have the right to ask us to update inaccurate information or complete information that is incomplete.

Right to be forgotten

You can request at any time that the information concerning you be deleted. There are few exceptions to the right to deletion, such as if the information must be kept to fulfill a legal obligation (e.g., under the Accounting Act).

Shapd Care AB is responsible for the storage and processing of personal data in the webshop and ensures compliance with the rules.

How we protect your personal information

We use industry standards such as SSL/TLS and one-way hash algorithms to store, process, and communicate sensitive information, such as personal information and passwords, securely.

Changes to the general terms

We reserve the right to make changes to the terms and conditions at any time. Changes to the terms and conditions will be published online on the website. The amended terms are considered accepted in connection with an order or visit to the website.

Conflict and choice of law

If a dispute cannot be resolved in accordance with the company's customer service and the customer, you as a customer can contact the Consumer Complaints Board, read here. For residents of another EU country than Denmark, complaints can be filed online via the EU Commission's platform for mediation in disputes, read here. In the event of a dispute, we follow the decision of ARN or a similar dispute resolution body. Disputes concerning the interpretation or application of these general terms shall be interpreted in accordance with Swedish law and regulation.

Privacy Policy

The data policy serves three purposes:

To clearly explain to you as a patient how we use the information you share with us.
To ensure that you understand what information we collect with your consent and what we do with it.
To hold us accountable for protecting your rights and personal integrity.

We need your personal information to provide secure and quality dental care. Therefore, we record personal information about you every time you contact us. Shapd continuously works on improvement. Therefore, your personal information is also used to follow up, develop, and improve our business. We process your personal information in accordance with the Patient Data Protection Act ("PDL") and the General Data Protection Regulation ("GDPR").

What information do we collect?

Information you provide us. You can directly or indirectly provide us with information about yourself in various ways, such as when you contact us via our website or other communication channels. When you book an appointment or visit our website. The personal information we collect may include: Personal and contact information - name, date of birth, social security number, email address, mobile phone number, communication preferences, etc.

Payment information - billing information, etc.
Device information - e.g., IP address, language settings, browser settings, time zone, operating system, platform, and screen resolution. (This is usually collected via so-called "cookies" and is something you can indirectly provide us with when you visit the Shapd website).

According to the law, we are obliged to keep a patient record for all our patients. Therefore, we have the right to record your personal information in our patient record, even if you have not given your consent. A patient record must always contain the following personal information:

Background of the treatment.
The reason for significant interventions.
Important information about initiated and planned interventions.

For your security, all calls going through Shapd's electronic patient record system are recorded. This is called log files. The calls are logged with time, user, treatment unit, treatment provider, and patient and can be used to track the treatment provider. This means that you can always see who, when, and what someone has done with your personal information.

In Chapter 3 of the Patient Data Protection Act (PDL), provisions can be found on what the obligation to document and keep a patient record entails. Basic provisions on what a patient record must contain can be found in Chapter 3, sections 5-8 and 11 of the PDL. A patient record must, among other things, contain the information necessary for good and safe treatment of the patient (Chapter 3, section 6 of the PDL).

What do we do with the information we have collected about you?

As mentioned earlier, your personal information is necessary to provide secure and quality dental care and to follow up, develop, and improve our business. Additionally, we need to report some of your personal information to the Insurance Fund and national health data registers.

Communication with you.

Shapd may also use your personal information to communicate and market Shapd. This can be to send invitations to your next visit or other agreed-upon time with us. But also to conduct customer satisfaction surveys regarding our services. This happens via electronic communication channels, telephone, and mail. If you do not wish to receive such communication or wish to change how we communicate, you are welcome to send an email to customer@shapd.se.

How long do we keep your personal information?

Personal information in a medical record is kept in accordance with the Patient Data Protection Act for at least ten years.

Who can we potentially share your information with?

Information about patients' health status or other personal matters is classified under the GDPR as "sensitive personal information." Therefore, the requirements and consequences of misuse of personal information are higher. In dental care, there is strict confidentiality about handling these types of information. Therefore, we will not disclose your personal information unless we are required to do so by laws and regulations, or with your explicit consent for such disclosure. To fulfill our obligations to you and to comply with laws and regulations, this does not exclude that we may share your personal information with suppliers. However, we would like to emphasize that suppliers do not have the right to use your personal information for purposes other than what is required to fulfill their agreement with Shapd. Such suppliers may, for example, be manufacturers of electronic patient record systems.

Shapd may also share your information with third parties:

In the event that Shapd sells or acquires a business or assets, Shapd may disclose your personal information to a potential seller or buyer of such business or assets.
If Shapd or a substantial part of Shapd's assets is acquired by a third party, personal information may be shared.

Where do we process your personal information?

We process all your data within the EU/EEA.

What rights do I have?

In connection with the new data protection regulation, you as a patient have the right to, among other things:

Right to access your data. You can request a copy of the information you want to know and verify the information we have about you. The copy is free to request.
Right to rectification. You have the right to correct incorrect or incomplete information about yourself.
Right to be forgotten. You have the right to request deletion of your personal information if the data is no longer needed for the purpose it was collected for. To have information deleted in your patient record, contact the Health and Care Inspectorate ("IVO") at www.ivo.se. After a decision from IVO, your data will be deleted by Shapd.

However, there may be legal obligations for Shapd and third parties that prevent us from deleting certain parts of your data immediately. These obligations stem from accounting and tax legislation as well as consumer protection legislation.

Protest against processing of information of general interest and exercise of authority.
When personal information is processed to perform a task of public interest or as part of the exercise of authority, you may have the right to object to the processing of personal information. You must specify what types of information you object to.

Withdraw your consent

If you withdraw your consent to the processing of personal information, no further information may be processed. You can withdraw your consent at any time. You do this by contacting us.

Block information in your patient record

NOTE! Your consent is required for other healthcare providers to access your information. You must always be informed about what "coordinated journaling" entails before another healthcare provider accesses your information. If you do not want your journal information to be electronically accessible to other healthcare providers, you can request that the information be completely or partially blocked for electronic access. You must then be informed about the consequences this may have for your treatment, e.g., that you yourself must inform the healthcare staff about what they need to know to provide you with good and safe treatment. You should also be aware that blocking can only be set up in the electronic record, not in a record that exists only in paper form.

Complaint and compensation

You have the right to lodge a complaint at any time regarding our processing of your personal information to us or to the Data Inspectorate. If personal information about you has been processed in a manner that violates the Patient Data Act and the General Data Protection Regulation, you may be entitled to compensation.

How do you exercise your rights?

Who is responsible for personal information and data protection advisor with us?

Shapd is responsible for the processing of your personal information according to this patient information. Shapd's data protection advisor is responsible for questions regarding data protection.

Treatment conditions

To achieve the desired outcome of orthodontic treatment (braces), a good collaboration between the dentist and the patient is required. Well-informed patients who follow their recommendations usually achieve very positive results.

Orthodontics, like any other medical field, has its limitations and potential risks, which you need to be aware of and consent to for further treatment. Usually, these risks do not pose any obstacles, but it is important that you are informed about them by Shapd so you can make decisions about continuing with the planned treatment. Make sure to discuss the risks with Shapd and explore all other available treatment options before starting your treatment.

If you have any questions, raise them with us so you have the opportunity to have them fully answered. Before approving to continue, you should be clear about what is expected of you as a patient (or as a guardian or parent) during the treatment period to achieve the best result and minimize potential risks.

About treatment with Shapd Pro Aligners

The purpose of the treatment is to align the teeth and/or improve bite function to achieve a final result consistent with traditional braces and your individual therapy plan. In orthodontic treatment with clear aligners, you, as the patient, wear a series of removable aligners that gradually move the teeth, instead of traditional braces. The aligners are made on behalf of Shapd by a selected dental laboratory in Germany. The design of the aligners is based on your dentist's prescription. Your authorized dentist at Shapd is responsible for your care.

Benefits of this type of orthodontic treatment compared to traditional braces include:

Clear aligners are less visible during treatment.
They are usually more comfortable.
They are removable, allowing you to eat, drink, and maintain oral hygiene during treatment as you did before.

Potential risks

Just like other procedures and treatments, orthodontic treatment with clear aligners carries risks. Risks may include (but are not limited to):

Treatment time may be longer than initially estimated. Reasons: Non-compliance with the dentist's/Shapd's recommendations, wearing aligners for fewer hours per day than recommended, poor oral hygiene, lack of follow-up appointments.

Consequence: Longer treatment time, less desired result.

The aligners may initially affect your speech. It is very rare for speech to be negatively affected over a longer period; most people quickly adapt to wearing the aligners and adjust their speech accordingly. Reason: Lack of experience wearing aligners.
Allergic reactions may occur in extremely rare cases. If you experience an allergic reaction, inform your dentist immediately. Reason: Allergy to plastic materials in the aligners.
Problems such as gum inflammation, cavities, periodontal disease, and dental deposits (permanent stains on the teeth) may occur if you do not maintain your daily oral hygiene or the preventive measures you usually take. These problems should not be considered a direct consequence of the treatment.
The aligners may affect restorations such as bridges and crowns. In certain cases, if they loosen, they may require replacement or cementation. Consult Shapd, who is responsible for the orthodontic treatment, before such procedures are performed as they may affect the fit of the aligners.
Orthodontic treatment should be permanent. However, in certain cases, teeth may return to their original position if you do not use your retainer as instructed.
Jaw problems may occur in very rare cases, causing jaw pain, discomfort, hearing problems, or headaches. If such problems arise, you should inform Shapd immediately.
Complications such as discomfort or delayed treatment results may occur if you do not follow the treatment plan. Therefore, it is important that you follow the instructions given by Shapd.
Some people experience sensitive teeth and mouth tenderness during treatment, especially when changing aligners.
For major tooth adjustments, temporary attachments may be necessary on the teeth. Some patients find these bothersome when not wearing the aligners.
In some patients with very little space in the mouth for alignment, it may be necessary to reduce the thickness of the enamel on the teeth (interproximal reduction, called IPR). This is done to create space for the teeth and promote alignment and usually does not cause problems for your teeth or mouth.
Some teeth may become more visible from the gum line after treatment.
In cases where the teeth have been overlapped for a long time before alignment, a gap may occur between the teeth at the gum line when the alignment is complete.
Orthodontic treatment can lead to root shortening (root resorption), including orthodontic treatment with clear aligners. In extremely rare cases, root resorption may cause teeth to become more mobile, but under otherwise healthy conditions, there is usually no risk.
If teeth are missing or if the teeth are very close together, the likelihood of the aligners breaking increases. If this happens, contact Shapd.
